● Article 1: General Provisions
The electronic webshop of Pharinex, a bv with registered office at Schilde 2970 Hoge Haar 24 Belgium, VAT BE 0890.931.043, RPR Antwerp, (hereinafter “Pharinex”) offers its customers the opportunity to purchase products online.
These Terms and Conditions (“Terms and Conditions”) apply to all items in the Pharinex product range and any purchase made by the customer from Pharinex. The customer accepts that these Terms and Conditions will be the only ones applicable, to the exclusion of his own general or specific (purchase) conditions, even if these would stipulate that they are the only ones applicable.
● Article 2: Price
All prices stated are in EURO and always include VAT and all other taxes that the customer is obliged to pay. If transportation, reservation or administrative fees are charged, this will be stated separately. The price stated applies only to the items as described verbatim. The accompanying photo is intended to be decorative and may contain elements, items not included in the price.
● Article 3: Offer
Each offer is only open to customers residing in the European Union. The items are intended for normal private use only. Despite the fact that the catalog and website are compiled with the utmost care, it is still possible that the information offered is incomplete, or contains material errors, or is not up to date. If you have specific questions about, for example, sizes, color, availability, delivery time or delivery method, please contact our customer service department in advance (see Article 12). Pharinex is regarding the accuracy, up to date, or completeness of the information offered only to a means commitment. In no event shall Pharinex be liable for material errors, misprints or omissions.

● Article 4: Online purchases
The customer has the option of purchasing items from the Pharinex range online. The purchase is made when the customer receives a confirmation email from Pharinex. Items will be delivered to the customer’s home on the delivery date indicated in the confirmation email. The customer has the choice between the following payment methods:

● Article 5: Retention of title
Delivered items remain the exclusive property of Pharinex until paid for in full by the customer. However, the risk due to loss or damage shall pass to the customer from the time of delivery. The customer undertakes, if necessary, to draw the attention of third parties to Pharinex’s retention of title, for example to anyone who might come to seize articles that have not yet been paid for in full.
● Article 6: Penalties for non-payment
Without prejudice to the exercise of other rights available to Pharinex, in the event of non-payment or late payment, the client shall be liable, ipso jure and without notice, to interest of 10% per annum on the unpaid amount. In addition, the customer shall be liable by operation of law and without notice to pay a fixed compensation of 10% on the amount in question, with a minimum of EUR 25 per invoice. Notwithstanding the foregoing, Pharinex reserves the right to take back items not paid for (in full).
● Article 7: Complaints
Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery, must be reported immediately, under penalty of lapse of any right. Not satisfied with your purchase or have a complaint? Let us know

● Article 8: Warranty
a. Legal warranty (for consumers only)
Under the Act of September 21, 2004 on the Protection of Consumers in the Sale of Consumer Goods, consumers have legal rights. Each item is subject to the statutory warranty from the date of purchase by (if applicable, delivery to) the first owner. Any commercial warranty does not affect these rights.
b. General
To invoke the warranty, the customer must be able to present proof of purchase.
For items purchased online and delivered to the customer’s home, the customer must contact Pharinex customer service in advance after which the customer must return the item to Pharinex at their expense.
Any defect must be reported within 2 months of its discovery. Thereafter, any right to repair or replacement shall lapse. The warranty (commercial and/or statutory) shall never apply to defects caused by accidents, neglect, falls, abnormal or incorrect use, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or alterations to the item, heavy-handed use, poor maintenance, abnormal or incorrect use. It also does not apply to items with a shorter life span, or wear items. Defects that manifest themselves after a period of 6 months following
date of purchase, if applicable delivery, shall be deemed not to be hidden defects, subject to evidence to the contrary by the Customer.
The warranty is not transferable.
● Article 9: Right of revocation
The provisions of this article apply only to customers who purchase items online in their capacity as consumers :

● Article 14: Proof
The customer accepts that electronic communications and backups can be used as

● Article 15: Applicable law – Competent court
Belgian law shall apply, with the exception of the provisions of private international law concerning applicable law and of the Rome I Regulation on international sales contracts relating to movable property. In case of any disputes, the courts of Antwerp shall have exclusive jurisdiction.
